By registering or using www.DigiPromise.com (the "Site"), you (the "User") signify that you have read, understood, and agree to be bound by these Terms of Use ("Terms of Use") whether or not you are a registered member of DigiPromise. We reserve the right to change, modify, add, or delete portions of these Terms of Use at any time without further notice, provided that DigiPromise will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, then do not use the Site. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use.
1. Registration Data; Account Security. You agree to (a) provide accurate, current, and complete information about yourself as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password and identification; and (c) be fully responsible for all use of your account and for any actions that take place using your account.
2. User Conduct.
a. The User has a nonexclusive, nontransferable, limited, and revocable right to use the Site solely for the User's personal, non-commercial use. The User will not use the Site for any other purpose, including any commercial purpose. The User agrees that no materials will contain libelous, defamatory or otherwise unlawful material. The User also agrees to use the Site in a manner consistent with any and all applicable laws and regulations.
b. The User agrees not to use the Site or to authorize any other person to use the Site to:
i. use the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site;
ii. upload, post, transmit, share, store or otherwise make available any content that the Company deems to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
iii. impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
3. Proprietary Rights in Site Content; Limited License.
a. Proprietary Rights. The User acknowledges and agrees that all content on the Site, including designs, text, graphics, pictures, information, software, and other files, and their selection and arrangement (the "Site Content"), are the property of DigiPromise and its content providers and that DigiPromise and its content providers retain all right, title, and interest in the Site Content. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without DigiPromise's prior written permission.
4. Limited License. Provided that the User is eligible to use the Site, the User is granted a limited license to access and use the Site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright, trademark, service mark, or other proprietary notices intact. The license granted by this Terms of Use does not permit the use of any data mining, robots or similar data gathering or extraction methods.
5. User Content Posted on the Site.
a. User Responsibility. You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, and other content that you upload, publish or display (hereinafter, "post") on or through the Site (collectively the "User Content"). You may not post, transmit, or share User Content on the Site that you did not create or that you do not have permission to post. You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of DigiPromise violates this Agreement.
6. Intellectual Property.
a. Copyright Protection.
i. You may not Post, distribute or reproduce in any way any copyrighted material, trademarks or service marks or other proprietary information owned by another party without obtaining the prior written consent of the copyright owner.
7. Third Party Websites and Content.
a. The Site contains (or you may be sent through the Site to) links to other web sites ("Third Party Sites"). DigiPromise is not responsible for any Third Party Sites accessed through the Site. Inclusion of, linking to, or permitting the use or installation of any Third Party Site or any Third Party Applications, Software or Content does not imply approval or endorsement thereof by us. If you decide to leave the Site and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that our terms and policies no longer govern.
b. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by DigiPromise.
8. Disputes between Users. You are solely responsible for your interactions with other DigiPromise users. We reserve the right, but have no obligation, to monitor disputes between you and other users.
9. Disclaimers.
a. Health Disclaimer. DigiPromise is not a medical organization. Nothing contained in this Agreement or on the Site should be construed as medical advice. The information offered by DigiPromise or made available on or through the Site should not be interpreted as a substitute for physician consultation, evaluation, or treatment. The User acknowledges that DigiPromise has no knowledge of any User's health condition(s) and that User alone is responsible for any actions User takes that may have any health or other risks to User.
b. Availability and Data Integrity. The Site may be temporarily unavailable from time to time for maintenance or other reasons. DigiPromise assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications including but not limited to User Content.
c. Results. DigiPromise cannot guarantee and does not promise any specific results from use of the Site and/or any Third Party Applications, Software or Content.
d. Reservation of Rights. The Company reserves the right, solely in its discretion, to
i. change any and all content, software and other items used or contained in the Site at any time without notice;
ii. modify and/or discontinue the Site at any time without notice; and
iii. terminate your username, password and account, should you be in violation of the Terms of Use.
Information Collected by DigiPromise. We collect the following types of information from DigiPromise users:
1. Information You Provide to Us. We receive and store any information you enter on our website or provide to us in any other way. You can choose not to provide us with certain information, but then you may not be able to take advantage of many of our special features.
2. Registration: In order for you to use DigiPromise you must create an account by completing a registration form. As part of this registration form, we require select personal information, including your full name, and email address.
3. User Profile: To allow you to express yourself beyond just the information collected during registration, we enable you to provide additional information in your User Profile. This information may include your location, your date of birth and your interests. In addition, you may choose to include photos of yourself in your User Profile.
Email Communications.
1. Based upon the personally identifiable information that you provide to us, we will send you a welcome email after you have registered with DigiPromise. DigiPromise may send out emails in response to your inquiries, to manage your account and to facilitate the actions described above in the "Use of information by DigiPromise" section. You may receive notification emails from DigiPromise, which inform you of actions performed on the site (e.g. friend requests and notifications).
Keeping Information Secure.
1. The security of your information is of paramount importance to us. Your DigiPromise account information is protected by a password for your privacy and security. In addition, we follow generally accepted industry standards to protect the personal information of our users, both during transmission and after we receive it.
2. You can enhance your security by protecting against unauthorized access to your password and to your computer by logging off once you have finished using a shared computer.
3. You may request deletion of your DigiPromise account by contacting us. We will respond to requests within five business days.
Changes to this Privacy Policy. DigiPromise may amend this Privacy Policy from time to time, at its sole discretion. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes to the Privacy Policy, we will notify you here, by email, or by posting an announcement on the DigiPromise website so you are always aware of what information we collect, how we use it, and under what circumstances if any, it is disclosed.
